The Food Museum Ltd is a company limited by guarantee (01819676) and a registered charity (293033), trading as the Food Museum. We also have a subsidiary company, the Stowmarket Museum Trading Company Limited (02802185), which is wholly owned by The Food Museum Ltd. The phrases ‘Food Museum’ and ‘museum’ used in this policy refer to both of these registered entities
Use of the websites owned by the The Food Museum Ltd – www.foodmuseum.org.uk, www.abbotshallweddings.co.uk and www.stowculture.co.uk – is governed by these Terms and Conditions.
Use of these websites is conditional upon acceptance of these Terms and Conditions and by using the websites a user accepts and agrees to be bound by the Terms and Conditions. If a user does not accept these terms and conditions, and therefore declines this agreement, they are prohibited from accessing and/or using the Service and should exit the websites immediately.
The Food Museum Ltd may at any time revise these Terms and Conditions without notice. It is up to the user to regularly review the Terms and Conditions in case there are any changes. Continued use of the websites after a change has been made is to be treated as acceptance of that change by the user.
COPYRIGHT AND CONTENT
Unless expressly stated, the copyright and other intellectual property rights (such as design rights, trademarks, patents etc.) in any material provided on the Food Museum websites remains the property of the Food Museum (or as the case may be another rightful owner).
The Food Museum may allow people to interact online regarding topics and content chosen by users of the websites, and users can alter the websites environment on a real time basis. Due to the nature of the websites, the Food Museum does not always or will not always be able to regulate the content/communications created and made available by users or otherwise. As a result the Food Museum has limited control, if any, over the quality, morality, legality, truthfulness or accuracy of various aspects of the websites.
By using the websites users may have access to graphics, sound effects, music, video, audio, computer programmes, animations, text and other creative output (“Content”); and Content provided by the Food Museum or by others such as the users of the websites (“Content Providers”).
The Food Museum and other Content Providers have rights in their respective Content under copyright and other applicable laws, and except as described in this agreement such rights are not transferred by mere use of the websites. Users accept full responsibility and liability for use of any Content in violation of any such rights. Users agree that their creation of Content is not in any way based upon any expectation of compensation from the Food Museum. Users acknowledge that this agreement does not assign or transfer ownership, title or interest of the Intellectual Property rights in the website to them.
LICENCES AND IPR
Subject to the Terms and Conditions of this agreement, the Food Museum hereby grants a non-exclusive, royalty free and revocable licence to access and use the websites and use its content in accordance with the Terms and Conditions for as long as users are in compliance with such Terms & Conditions.
Content owned or licensed to the Food Museum can be used by any user of the websites for any such purposes that are conducive to education, teaching, learning, private study and/or research.
Users of the websites can create Content in various forms. The Food Museum acknowledges and agrees that, subject to the Terms and Conditions, users will retain any and all applicable copyright and any other intellectual property rights with respect to any Content they create, to the extent that they have such rights under applicable law.
Notwithstanding the foregoing, users understand and agree that by submitting their Content to any area of the websites, they automatically grant (and they represent and warrant that they have the right to grant) to the Food Museum a non-exclusive, royalty free, perpetual licence to use, reproduce and communicate their Content and a right to sub-licence such use to users of the websites and to use and reproduce and to authorise third parties to use and reproduce any of their Content in any or all media for marketing and/or promotional purposes in connection with the websites.
Users agree that by submitting their Content to any area of the websites, they automatically grant to users of the websites who want to use their Content or parts of it outside the websites a non-exclusive, royalty free, perpetual licence.
Users understand and agree that by submitting their Content to any area of the websites they automatically grant (or they warrant that the owner of such Content has expressly granted) to the Food Museum and to all other users of the websites a non-exclusive, worldwide, royalty-free, perpetual licence under any and all patent rights they may have or obtain with respect of their Content, to use their Content for all purposes within the websites.
Users agree to use all best efforts to ensure that their Content does not infringe any Intellectual Property rights of a third party.
Users agree that even though you may retain certain copyright or other intellectual property rights with respect of the Content they create while using the websites, they do not own the account they use to access the websites, nor do they own any data the Food Museum holds which has been submitted by others. Users’ intellectual property rights do not confer ownership of others’ data stored by or on behalf of the Food Museum.
LOGOS
The use of the Food Museum logo or the logos of any associated or subsidiary organisations must not be used for promotional or linking purposes unless prior approval in writing has been given. Please contact the Museum on +44 (0) 1449 612229 or email enquiries@foodmuseum.org for such approval.
LINKS
The websites may contain links to other websites over which the Food Museum has no control. Such links are supplied solely for the convenience of users. The Food Museum is not responsible for the contents or reliability of the linked websites and does not necessarily endorse the views expressed within them or the organisation or persons providing them in any way. The Food Museum does not guarantee that these links will work all of the time and we have no control over the availability of the linked pages.
Providers of other websites may place text-based links to pages on the Food Museum websites without seeking prior permission. However such links must not open the Food Museum websites pages into frames within another website. Pages from the Food Museum websites must be loaded into the user’s entire browser window.
PRIVACY
Users acknowledge and agree that the Food Museum in its sole discretion, may track, record, observe or follow any and all of their interactions within the websites. The Food Museum may share general, demographic or aggregated information with third parties about Food Museum’s user base and websites usage, but that information will not be include or be linked to any personal information without consent. The Food Museum agrees that when exercising these rights, it shall abide by the Data Protection Act, 2018 at all times.
DISCLAIMER
While the Food Museum tries hard to ensure that the websites are functioning correctly and information contained therein is as accurate as possible, this will not always be achievable and therefore the following disclaimer applies.
The websites are provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, compatibility, non-infringement, accuracy and security. The Food Museum does not guarantee or represent that the content and/or facilities available or accessible via the websites will always be accurate, complete or current or that access to the websites will be uninterrupted.
The Food Museum expressly disclaims all liability for any direct, indirect or consequential loss or damage occasioned from the use or inability to use the websites, whether directly or indirectly resulting from inaccuracies, defects, viruses, errors (whether typographical or otherwise), omissions, out of date information or otherwise.
Accessing the websites and the downloading of material from them is done entirely at the user’s own risk. The user, and not the Food Museum, will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if the Food Museum has been advised of the possibility of such damage.
JURISDICTION
These terms and conditions will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between a user and the Food Museum arising out of the access or use of these websites. Omission by the Food Museum to exercise any right under these terms and conditions will not constitute a waiver of such right unless expressly stated by the Food Museum in writing.
